Read the concurring and dissenting opinions from the Ninth Circuit Court of Appeals

Here is a link to the decision of the Ninth Circuit Court of Appeals not to review the decision of a panel of the Court issued February 9th, which rejected a challenge to the decision of the (Washington State) District Court to issue a temporary restraining order against the first Executive Order.

It is worth reading the several concurring and dissenting opinions–both for the discussion of the merits of the case as well as some broader comments on the context in which the case arises.

Of course, all this becomes more interesting as Senate hearings begin on the confirmation of Judge Gorsuch to the Supreme Court.  I think it is unlikely that a Supreme Court with a conservative majority would be willing to rely on the statements of candidate Trump and Rudy Giuliani to invalidate the Order.
